مرحباً بك في مليان. هذه الوثيقة تشرح شروط استخدام التطبيق: حجز الرحلات داخل المدينة، وحجز مقاعد النقل بين المحافظات، وطلب التوصيل من المطاعم والأسواق.

باستخدامك التطبيق فإنك توافق على ما يلي. وإن لم توافق، فلا تستخدمه.

🤝 ما هي مليان؟

مليان منصّة وساطة: تربط الراكب بسائقٍ مستقلّ، والزبون بمتجرٍ مستقلّ.

• السائقون والتجّار ليسوا موظّفين لدينا — هم مقدّمو خدمة مستقلّون.
• الخدمة نفسها (النقل، الطعام، البضاعة) مسؤولية مقدّمها لا مسؤوليتنا.
• دورنا: الربط، وتحديد الأجرة، وحفظ السجلّ، وفضّ النزاع بما لدينا من بيانات.

📱 الحساب

• التسجيل برقم هاتف عراقيّ ورمز تحقّق (OTP) — لا كلمات مرور.
• يجب أن تكون ١٨ سنة فأكثر، وأن تكون البيانات التي تدخلها صحيحة.
• حسابك لك وحدك. أنت مسؤول عن كل ما يجري منه، ولا يجوز إعارته أو بيعه.
• حساب السائق لا يعمل قبل موافقة الإدارة على وثائقه، وأي تعديل على المركبة أو الوثائق يمرّ بموافقةٍ جديدة.
• تستطيع تعطيل حسابك من «حسابي» في أي وقت. يتوقّف الحساب فوراً ويبقى سجلّ الرحلات والمستحقّات محفوظاً للمحاسبة وفضّ النزاع.

🚕 الرحلات

• الأجرة تُحسب من المسافة والزمن ومنطقة الانطلاق، وتُعرض عليك قبل التأكيد.
• في بعض الرحلات يُعرض سعرٌ يرتفع تدريجياً حتى يقبله سائق — وما تراه عند القبول هو ما تدفعه.
• الدفع نقداً للسائق مباشرةً عند انتهاء الرحلة.
• قد يُضاف مبلغٌ للرحلة الفاخرة أو المحطات الإضافية أو الذهاب والعودة، ويظهر في السعر المعروض.
• الإلغاء المتكرّر أو بلا سببٍ مقبول قد يؤدّي إلى تقييد الحساب.

🛵 التوصيل والمتاجر

• الأسعار والأصناف وأوقات العمل يحدّدها التاجر لا نحن.
• جودة الطعام والبضاعة وسلامتهما مسؤولية التاجر.
• إن نفد صنفٌ بعد الطلب، يقترح عليك التاجر بديلاً أو حذفه — والقرار لك قبل قبول الطلب.
• العروض والخصومات يعلنها التاجر، وتُطبَّق كما تظهر في السلّة عند إتمام الطلب.
• الدفع نقداً عند الاستلام ما لم يُذكر غير ذلك.

💰 المحفظة والعمولة (للسائقين والتجّار)

• تُخصم عمولة من محفظة مقدّم الخدمة على كل رحلةٍ أو طلبٍ مكتمل، ونسبتها معروضة في التطبيق.
• قد ينزل الرصيد تحت الصفر فيصير دَيناً يُسدَّد من أول شحن.
• لا تصله طلباتٌ جديدة ما دام رصيدُه لا يكفي.
• الشحن يتمّ عبر الإدارة، وأي مبلغٍ يُدفع نقداً خارج التطبيق ليس من مسؤوليتنا.

⭐ التقييم والسلوك

• يُقيَّم مقدّمو الخدمة بـ👍 / 👎، ويظهر الرقم كنسبة رضا.
• يُمنع منعاً باتّاً: الإساءة، التحرّش، التهديد، التمييز، أو أي سلوكٍ يهدّد السلامة.
• يُمنع استعمال التطبيق لنقل ممنوعاتٍ أو لأي غرضٍ مخالفٍ للقانون العراقي.
• مخالفة ذلك تعني إيقاف الحساب فوراً، وقد تُحال الواقعة إلى الجهات المختصّة.

🎙️ التسجيل الصوتي للأمان

قد يُسجَّل صوت رحلة التكسي/التكتك لأغراض السلامة، وتظهر لك شارة واضحة في كل رحلة مسجَّلة. التسجيل مشفَّر ولا يستطيع أحدٌ سماعه — لا السائق ولا الراكب — ويُحذف تلقائياً بعد ١٥ يوماً ما لم يوجد بلاغ. التفاصيل في سياسة الخصوصية.

⚖️ حدود المسؤولية

• نبذل ما بوسعنا لإبقاء الخدمة تعمل، لكنّنا لا نضمن عملها بلا انقطاع — قد تنقطع الشبكة أو الخادم أو خدمة الخرائط.
• لا نتحمّل ضرراً ناتجاً عن سلوك سائقٍ أو تاجرٍ أو مستخدمٍ آخر.
• لا نتحمّل ما تفقده من متاعٍ أثناء الرحلة، وإن ساعدناك في الوصول إلى الطرف الآخر.
• مسؤوليتنا في كل حالٍ لا تتجاوز قيمة الرحلة أو الطلب محلّ النزاع.

🔄 تعديل الشروط

قد نحدّث هذه الشروط، ونعلن التاريخ في أعلى الصفحة. استمرارك في استخدام التطبيق بعد التحديث يُعدّ موافقةً على الشروط الجديدة.

ويجوز لنا إيقاف حسابك أو الخدمة كلّها عند مخالفةٍ جسيمة أو لضرورةٍ قانونية.

🏛️ القانون الواجب التطبيق

تخضع هذه الشروط لقوانين جمهورية العراق، وتختصّ محاكمها بالنظر في أي نزاعٍ ينشأ عنها.

Welcome to Mlyan. These terms cover using the app: booking rides within the city, booking intercity seats, and ordering delivery from restaurants and markets.

By using the app you agree to the following. If you do not agree, please do not use it.

🤝 What Mlyan is

Mlyan is an intermediary platform connecting riders with independent drivers, and customers with independent stores.

• Drivers and merchants are not our employees — they are independent providers.
• The service itself (transport, food, goods) is the provider's responsibility, not ours.
• Our role: matching, fare calculation, record keeping, and dispute resolution using the data we hold.

📱 Your account

• Registration uses an Iraqi phone number and an OTP code — no passwords.
• You must be 18 or older and provide accurate information.
• Your account is yours alone. You are responsible for activity on it; it may not be lent or sold.
• A driver account does not operate until admin approval of documents; vehicle or document changes require new approval.
• You may deactivate your account from the profile screen at any time. Access stops immediately; trip and settlement records are retained for accounting and dispute resolution.

🚕 Rides

• Fares are based on distance, time and pickup zone, and are shown before you confirm.
• Some rides show a price that rises gradually until a driver accepts — what you see at acceptance is what you pay.
• Payment is cash, directly to the driver at the end of the ride.
• Extra charges may apply for premium rides, additional stops, or round trips, and appear in the displayed price.
• Repeated or unjustified cancellations may lead to account restrictions.

🛵 Delivery and stores

• Prices, items and opening hours are set by the merchant, not by us.
• Quality and safety of food and goods are the merchant's responsibility.
• If an item runs out after ordering, the merchant proposes a replacement or removal — the choice is yours before the order is accepted.
• Offers and discounts are declared by the merchant and applied as shown in the cart at checkout.
• Payment is cash on delivery unless stated otherwise.

💰 Wallet and commission (drivers and merchants)

• A commission is deducted from the provider's wallet for each completed ride or order; the rate is shown in the app.
• The balance may go below zero and become a debt, settled from the next top-up.
• No new orders are received while the balance is insufficient.
• Top-ups are handled by the administration; cash paid outside the app is not our responsibility.

⭐ Ratings and conduct

• Providers are rated with 👍 / 👎, shown as a satisfaction percentage.
• Strictly prohibited: abuse, harassment, threats, discrimination, or any behaviour that endangers safety.
• Using the app to carry prohibited items or for any purpose contrary to Iraqi law is forbidden.
• Violations lead to immediate account suspension and may be referred to the authorities.

🎙️ Safety audio recording

Taxi/tuk-tuk rides may be audio recorded for safety, with a clear badge shown on every recorded ride. Recordings are encrypted and cannot be listened to by the driver or the rider, and are deleted automatically after 15 days unless a report exists. Details in the Privacy Policy.

⚖️ Limitation of liability

• We work to keep the service running but do not guarantee uninterrupted operation — networks, servers or map services may fail.
• We are not liable for harm caused by the conduct of a driver, merchant or other user.
• We are not liable for belongings lost during a ride, though we will help you reach the other party.
• In all cases our liability does not exceed the value of the ride or order in dispute.

🔄 Changes to these terms

We may update these terms and will show the date at the top of this page. Continued use after an update constitutes acceptance of the new terms.

We may suspend your account or the service in cases of serious violation or legal necessity.

🏛️ Governing law

These terms are governed by the laws of the Republic of Iraq, whose courts have jurisdiction over any dispute arising from them.
